米国移民局は2023年9月25日、来たる10月1日よりフォームI-539（非移民ステータス延長/変更申請）の申請要件の一部であるバイオメトリックスサービス料金を免除することを発表しました。当初、 USCISは4月19日、フォームI-539を提出する特定の申請者に対するバイオメトリックスの提出要件の一時停止を9月30日まで延長すると発表していました。なお、本日の発表においてUSCISは全てのI-539申請者に対し、この要件を撤廃する予定であることも発表しました。
注目点：
– 10月1日より、フォームI-539（非移民ステータス延長/変更申請）の申請手続きの一環であった、バイオメトリックスサービス料金$85を免除。
– 10月1日以降の消印（ポストマーク）の付いた申請であれば、申請者はこの$85を支払う必要はありません。ただし、10月1日以前にI-539を提出した特定の申請者については、ASCのアポイントメントが設定されますので、その場合は出向くことが必要。
– ほとんどの場合、申請者はバイオメトリックス・サービスが設定されることはないでしょう。しかし、USCISによりバイオメトリックスが必要と判断された場合、申請者にはバイオメトリックス・サービスの予約に関する情報が記載された通知が送付されます。
– 申請者が誤ってバイオメトリックス・サービス料金を提出する場合で、フォームI-539の料金とは別に支払いが行われた場合、バイオメトリックス・サービス料金については返金をし、フォームI-539による申請は受理します。
– 一方、申請者が誤ってバイオメトリックスサービス料金を提出する場合で、その費用の支払いが紙媒体によるフォームI-539申請費用と合算されていた場合、誤った申請費用とみなされ、フォームI-539申請は受け付けられず却下されます。
– 申請者が誤ってバイオメトリックスサービス料金と申請料金を合算したクレジットカードでの支払いを承認した場合、申請書は受理され、申請費用のみが請求されます。
USCIS Exempts the Form I-539 Biometric Services Fee for All Applicants
U.S. Citizenship and Immigration Services (USCIS) today announced the exemption of the biometric services fee as part of the application requirements for Form I-539, Application to Extend/Change Nonimmigrant Status, beginning Oct. 1. Background On April 19, USCIS announced that the agency was extending temporary suspension of the biometrics submission requirements for certain applicants filing Form I-539 until Sept. 30. USCIS also announced plans to remove the requirement for all I-539 applicants.
Policy Highlights
• Beginning Oct. 1, we are exempting the $85 biometric services fee as part of the application process for Form I-539, Application to Extend/Change Nonimmigrant Status.
• Applicants do not need to pay the fee if their application is postmarked Oct. 1 or later. However, certain applicants who file Form I-539 prior to Oct. 1 will still be scheduled for an ASC appointment and should still attend.
• In most cases, applicants will not be scheduled to attend a biometric services appointment. However, if USCIS determines that biometrics are required, the applicant will receive a notice with information about appearing for their biometric services appointment.
• If an applicant mistakenly submits the biometric services fee and the payment is submitted separately from the Form I-539 fee, we will return the biometric services fee and accept the Form I-539.
• If an applicant mistakenly submits the biometric services fee and the payment is combined with a paper-based Form I-539 filing fee, this is considered an incorrect filing and we will reject the Form I-539.
• If an applicant mistakenly authorizes a credit card payment that combines the biometric services fee with the application fee, we will accept the application and only charge the application fee.
