On July 18, 2025, U.S. Citizenship and Immigration Services (USCIS) announced that it has received sufficient petitions to meet the congressionally mandated H-1B cap for fiscal year 2026. This includes both the regular cap of 65,000 and the additional 20,000 slots allocated under the U.S. advanced degree exemption (master’s cap).
As a result, there will likely be no second round of H-1B lottery selections for this fiscal year.
USCIS will continue to accept and process H-1B petitions that are cap-exempt, including those filed to:

Extend the stay of current H-1B workers;

Amend terms of H-1B employment;

Change of H-1B employers; and
-
Concurrent H-1B employment.
Employers and foreign professionals are encouraged to consult with immigration counsel to evaluate alternative visa options or prepare early for next year’s cap season.
