CFR \u00a7656.17(h)(2) \u306b\u57fa\u3065\u304f\u76e3\u67fb\u306b\u3064\u306a\u304c\u308a\u3084\u3059\u3044\u3053\u3068\u306f\u3001\u5341\u5206\u306b\u7acb\u8a3c\u3055\u308c\u3066\u3044\u307e\u3059\u3002PERM\u52b4\u50cd\u8005\u8a3c\u660e\u66f8\u3092\u4f5c\u6210\u3059\u308b\u969b\u306b\u3001\u3053\u306e\u8981\u4ef6\u306e\u300c\u696d\u52d9\u4e0a\u306e\u5fc5\u8981\u6027\u300d\u3092\u660e\u78ba\u306b\u6587\u7ae0\u5316\u3059\u308b\u65b9\u6cd5\u306b\u3064\u3044\u3066\u306f\u69d8\u3005\u306a\u8a18\u8ff0\u304c\u3042\u308a\u3001\u30d5\u30a9\u30fc\u30e0ETA class=\"x_ContentPasted1\">\n<p class=\"x_ContentPasted1\">The Board of Alien Labor Certification Appeals (BALCA) recently issued decisions in which the underlying PERM filing was denied because the employer rejected applicants based solely on a review of the resume. In both cases, BALCA agreed that the respective employers established that foreign language fluency was a business necessity for the position and that the requirement was clearly stated; however, in one case, the denial was vacated, and in the other, it was upheld. The difference hinges on the disqualification of applicants and raises the question of when it is acceptable to reject an applicant on the face of their resume.<\/p>\n<p class=\"x_ContentPasted1\">In<span class=\"x_ContentPasted1\">\u00a0<\/span><a class=\"x_ContentPasted1\" title=\"https:\/\/www.oalj.dol.gov\/DECISIONS\/ALJ\/PER\/2019\/In_re_THE_LAW_OFFICES_OF_S_2019PER00034_(MAY_31_2022)_214930_CADEC_PD.PDF?_ga=2.21433659.1430328034.1669658209-1325622849.1648666415\" contenteditable=\"false\" href=\"https:\/\/www.oalj.dol.gov\/DECISIONS\/ALJ\/PER\/2019\/In_re_THE_LAW_OFFICES_OF_S_2019PER00034_(MAY_31_2022)_214930_CADEC_PD.PDF?_ga=2.21433659.1430328034.1669658209-1325622849.1648666415\" target=\"_blank\" rel=\"noopener\" data-feathr-click-track=\"true\" data-feathr-link-aids=\"[&quot;5d8e321eda01ba002363ba39&quot;]\"><em>The Law Offices of Simone Bertollini, LLC,\u00a0<\/em>2019-PER-00034<\/a><span class=\"x_ContentPasted1\">\u00a0<\/span>(May 31, 2022), BALCA affirmed the denial of a PERM certification for a position requiring fluency in Italian because the employer rejected an applicant whose resume \u201cindicated the possibility that [the applicant] was minimally qualified and could have performed the job duties, and that the Employer therefore had an obligation to interview.\u201d In this case, the applicant did list \u201cknowledgeable in Italian\u201d on the resume. Because the \u201cresume was not silent on the language requirement,\u201d the Board found that the applicant\u2019s \u201cknowledge\u201d of Italian raised the reasonable possibility that the applicant met the language requirement.<\/p>\n<p class=\"x_ContentPasted1\">In August 2022, BALCA similarly held that when a business necessity for a foreign language requirement is established, the employer may reject an applicant \u201cif it is clear on the face of a resume that a U.S. applicant does not meet the job requirements listed on the Form 9089.\u201d<span class=\"x_ContentPasted1\">\u00a0<\/span><a class=\"x_ContentPasted1\" title=\"https:\/\/www.oalj.dol.gov\/DECISIONS\/ALJ\/PER\/2019\/In_re_T_UP_TRADING_INC_2019PER00086_(AUG_25_2022)_150224_CADEC_PD.PDF?_ga=2.20962232.1430328034.1669658209-1325622849.1648666415\" contenteditable=\"false\" href=\"https:\/\/www.oalj.dol.gov\/DECISIONS\/ALJ\/PER\/2019\/In_re_T_UP_TRADING_INC_2019PER00086_(AUG_25_2022)_150224_CADEC_PD.PDF?_ga=2.20962232.1430328034.1669658209-1325622849.1648666415\" target=\"_blank\" rel=\"noopener\" data-feathr-click-track=\"true\" data-feathr-link-aids=\"[&quot;5d8e321eda01ba002363ba39&quot;]\"><em>T UP Trading, Inc.,<\/em>\u00a02019-PER-00086 (Aug. 25, 2022)<\/a>. In<span class=\"x_ContentPasted1\">\u00a0<\/span><em class=\"x_ContentPasted1\">T Up Trading<\/em>, the employer stated in Section H.14 that the job required fluency \u201cin Japanese for both speaking and writing to communicate with owners of Japanese supermarkets via phone, fax and email.\u201d<span class=\"x_ContentPasted1\">\u00a0<\/span><em class=\"x_ContentPasted1\">Id.<\/em><span class=\"x_ContentPasted1\">\u00a0<\/span>at 2. The business necessity was not disputed, and therefore, BALCA found that because the rejected applicants\u2019 \u201cresumes were silent on a principal requirement for the job opportunity, the denial\u2026cannot be sustained.\u201d<span class=\"x_ContentPasted1\">\u00a0<\/span><em class=\"x_ContentPasted1\">Id<\/em>. at 4. This decision also highlighted that because the Form ETA 9089 did<span class=\"x_ContentPasted1\">\u00a0<\/span><em class=\"x_ContentPasted1\">not<\/em><span class=\"x_ContentPasted1\">\u00a0<\/span>indicate that the employer would accept an applicant based on a suitable \u201ccombination of education, training and experience,\u201d the employer was not required to consider applicants who did not list a major requirement on their resumes.<\/p>\n<p class=\"x_ContentPasted1\">It has been<span class=\"x_ContentPasted1\">\u00a0<\/span><a class=\"x_ContentPasted1\" title=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/ETA\/oflc\/pdfs\/PERM_Audit_Webinar_Presentation-08.17.17.pdf\" contenteditable=\"false\" href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/ETA\/oflc\/pdfs\/PERM_Audit_Webinar_Presentation-08.17.17.pdf\" target=\"_blank\" rel=\"noopener\" data-feathr-click-track=\"true\" data-feathr-link-aids=\"[&quot;5d8e321eda01ba002363ba39&quot;]\">well established<\/a><span class=\"x_ContentPasted1\">\u00a0<\/span>that a foreign language requirement in a labor certification application is an audit trigger under 20 CFR \u00a7656.17(h)(2). Much has been written about how to clearly document the \u201cbusiness necessity\u201d for this requirement when preparing a PERM labor certification case, including a<span class=\"x_ContentPasted1\">\u00a0<\/span><a class=\"x_ContentPasted1\" title=\"https:\/\/www.aila.org\/infonet\/practice-pointer-using-section-h14-of-eta-form\" contenteditable=\"false\" href=\"https:\/\/www.aila.org\/infonet\/practice-pointer-using-section-h14-of-eta-form\" data-feathr-click-track=\"true\" data-feathr-link-aids=\"[&quot;5d8e321eda01ba002363ba39&quot;]\">DOL Liaison Committee practice resource<\/a><span class=\"x_ContentPasted1\">\u00a0<\/span>on using Section H.14 of the Form ETA 9089 to reduce the potential for an audit. In these recent cases, the certifying officer (CO) and BALCA affirm that this necessity was sufficiently established on the face of the application and through audit responses. The denials were issued because the employer in each case rejected applicants on the face of the resumes.
