{"id":574,"date":"2017-04-03T15:29:42","date_gmt":"2017-04-04T03:29:42","guid":{"rendered":"https:\/\/swlgpc.com\/en\/blog\/?p=574"},"modified":"2017-04-03T15:29:42","modified_gmt":"2017-04-04T03:29:42","slug":"uscis-announces-measures-to-detect-h-1b-fraud-and-abuse","status":"publish","type":"post","link":"https:\/\/www.swlgpc.com\/eng\/uscis-announces-measures-to-detect-h-1b-fraud-and-abuse\/","title":{"rendered":"USCIS ANNOUNCES MEASURES TO DETECT H-1B FRAUD AND ABUSE"},"content":{"rendered":"<p>Beginning on April 3, 2017, the United States Citizenship and Immigration Services (USCIS) will <a href=\"https:\/\/www.uscis.gov\/news\/news-releases\/putting-american-workers-first-uscis-announces-further-measures-detect-h-1b-visa-fraud-and-abuse\">take a more targeted approach<\/a> when visiting worksites of H-1B petitioners and H-1B employees.<\/p>\n<p>As a part of an ongoing initiative to deter and detect H-1B fraud and abuse, USCIS aims to protect American workers by focusing on worksite visits where H-1B fraud and abuse may be more likely to occur, including:<\/p>\n<ul>\n<li>H-1B employer\u2019s basic business information cannot be validated through commercially available data;<\/li>\n<li>H-1B employers who have a high ratio of H-1B employees compared to U.S. workers (also known as \u201cH-1B dependent employers\u201d); or<\/li>\n<li>H-1B employees who work off-site from the H-1B employer\u2019s main worksite.<\/li>\n<\/ul>\n<p>USCIS has also established an email address that is designated for receiving any tips, alleged violations, and other relevant information about potential H-1B fraud or abuse.<\/p>\n<p>In light of these new measures, H-1B employers should be mindful of an increased likelihood of random and unannounced worksite visits if they meet any of the criteria mentioned above.
