{"id":2418,"date":"2018-12-04T10:48:04","date_gmt":"2018-12-04T17:48:04","guid":{"rendered":"https:\/\/swlgpc.com\/eng\/?p=2418"},"modified":"2018-12-04T10:48:04","modified_gmt":"2018-12-04T17:48:04","slug":"clarification-l-1-requirement","status":"publish","type":"post","link":"https:\/\/www.swlgpc.com\/eng\/clarification-l-1-requirement\/","title":{"rendered":"Clarifications on L-1 One-Year Foreign Employment Requirement"},"content":{"rendered":"<p>On November 15, 2018, the United States Citizenship and Immigration Services (USCIS) published a\u00a0<a href=\"http:\/\/links.govdelivery.com:80\/track?type=click&amp;enid=ZWFzPTEmbWFpbGluZ2lkPTIwMTgxMTI5Ljk4MzQ3MDAxJm1lc3NhZ2VpZD1NREItUFJELUJVTC0yMDE4MTEyOS45ODM0NzAwMSZkYXRhYmFzZWlkPTEwMDEmc2VyaWFsPTE3NTY4ODE0JmVtYWlsaWQ9d29uZ0BzaW5kZWxsbGF3LmNvbSZ1c2VyaWQ9d29uZ0BzaW5kZWxsbGF3LmNvbSZmbD0mZXh0cmE9TXVsdGl2YXJpYXRlSWQ9JiYm&amp;&amp;&amp;100&amp;&amp;&amp;https:\/\/www.uscis.gov\/sites\/default\/files\/USCIS\/Laws\/Memoranda\/2018\/2018-11-15-PM-602-0167-L-1-foreign-employment-requirement.pdf\" target=\"_blank\" rel=\"noopener\">policy memorandum<\/a> that provided clarification regarding the one-year foreign employment requirement for the L-1 nonimmigrant classification.<\/p>\n<p>The L-1 nonimmigrant classification allows an employer to transfer an executive or manager (<a href=\"https:\/\/www.uscis.gov\/working-united-states\/temporary-workers\/l-1a-intracompany-transferee-executive-or-manager\" target=\"_blank\" rel=\"noopener\">L-1A<\/a>) or an employee with specialized knowledge (<a href=\"https:\/\/www.uscis.gov\/working-united-states\/temporary-workers\/l-1b-intracompany-transferee-specialized-knowledge\" target=\"_blank\" rel=\"noopener\">L-1B<\/a>) from one of its qualifying foreign offices to one of its offices in the United States. Amongst the qualification for L-1, an employee is required to \u201cgenerally have been working for a qualifying organization abroad for one continuous year within the three years immediately preceding his or her admission to the United States.\u201d<\/p>\n<p>The new policy memorandum provides clarification for how to calculate the one-year foreign employment requirement as well as adjustments to the three-year period to ensure that the adjudication of L-1 petitions by USCIS are consistent. According to the policy memorandum:<\/p>\n<ul>\n<li>The L-1 beneficiary must be physically outside the United States <u>during<\/u> the required one continuous year of employment (although in certain cases brief trips to the United States for do not interrupt, or break, the one continuous year);<\/li>\n<li>The petitioner and the beneficiary must meet all requirements, including the one year of foreign employment,\u00a0<u>at the time the petitioner files the initial L-1 petition<\/u>;<\/li>\n<li>Any time the beneficiary spent working \u201cfor\u201d the qualifying organization in the United States (for example, as a principal beneficiary of an employment-based nonimmigrant petition or application) <u>results in an adjustment<\/u> of the three-year period for determining whether the beneficiary has met the one-year foreign employment requirement.<\/li>\n<li>Periods of employment with the qualifying organization in the United States as a dependent or student <u>do not<\/u> result in an adjustment of the three-year period for determining whether the beneficiary has met the one-year foreign employment requirement<\/li>\n<li>Periods of time in the United States not working or working for an unrelated employer <u>do not<\/u> result in an adjustment of the three-year period for determining whether the beneficiary has met the one-year foreign employment requirement<\/li>\n<\/ul>\n<p>Please do not hesitate to contact us if you have any questions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On November 15, 2018, the United States Citizenship and Immigration Services (USCIS) published a\u00a0policy memorandum that provided clarification regarding the one-year foreign employment requirement for the L-1 nonimmigrant classification.
